In that case, HP used private investigators to "pretext" (fraudulently obtain phone records) to identify which board members were leaking information to the press. While the fictional Samantha Weaver is portrayed as a murderer, Fiorina was never charged with such crimes and the "lesbian sub-plot" was an entirely fictional addition for the show.
